The Problem of Peer Review in Militant Democracy

Militant democracy is generally considered a means to protect a democracy through rights restrictions. The classic model applies in a domestic context, but Article 7 TEU should also be read as an application of militant democracy at the supranational level. Who should decide on militant measures? The classic answer has been courts. But is there a role for what one might call peer review? After all, Article 7 relies on the notion that Member State governments assess other Member State governments. Is this a good idea, or not?
